Who enforces laws, ordinances, permitting, and other situations that arise in a Municipal Utility District?
According to the Texas Water Code, Chapter 54, Section 205, A municipal utility district like Brushy Creek MUD may adopt and enforce reasonable rules and regulations to:
- Secure and maintain safe, sanitary, and adequate plumbing installations, connections, andappurtenances as subsidiary parts of its sanitary sewer system;
- Preserve the sanitary condition of all water controlled by the district;
- Prevent waste or the unauthorized use of water controlled by the district;
- Regulate privileges on any land or any easement owned or controlled by the district; and
- Provide and regulate a safe and adequate freshwater distribution system.
In addition to their common water and wastewater service functions, MUDs are legally empowered to engage in electrical generation, firefighting, and recreational activities (such as parks, swimming pools, and sports courts). A MUD can provide the recreational amenities approved by the Board of Directors and funded by the District.
According to the Texas Water Code, MUDs may also hire peace officers to operate within their districts. BCMUD has a security staff that patrols the District and enforces certain rules. However, when it comes to enforcement of other laws and ordinances, MUDs often broker interlocal agreements with outside entities. The main entity that enforces laws in BCMUD is the Williamson County Sheriff’s Office (WCSO), but other issues such as permitting and infrastructure maintenance also require oversight.
The following noncomprehensive list details entities that would enforce various laws and/or policies within BCMUD boundaries*:
